To distill the No Adverse Impact Legal Guide for Flood Risk Management (NAI Legal Guide) into a readable and usable resource for people who are not attorneys so that these professionals can more effectively work with their attorneys and provide their attorneys links to parts of the Guide relevant to the professional floodplain stewards’ concerns.
An update of the NAI Legal Guide, developed by the ASFPM Flood Science Center in partnership with ASFPM NAI Policy Committee, was released in 2023. The NAI Legal Guide supplements and helps update the legal resources that support NAI and flood risk management overall. It is publicly available through ASFPM’s digital library and provides detailed case law for legal professionals, and legal essentials for floodplain administrators, elected officials, and planners. The Legal Guide covers, but is not limited to, topics such as takings, liability, higher regulatory standards, and property rights. The legal resources developed support NAI workshop training and awareness through an ASFPM-wide webinar.
